Why it costs you sales

US law requires the choking-hazard statement on every internet listing of latex balloons sold in the US (15 U.S.C. 1278(c); the wording is in 16 CFR 1500.19(b)(2)): children under 8 can choke or suffocate on uninflated or broken balloons, and the CPSC says more children have suffocated on balloons than on any other type of toy.

It looks for the statement, or any part of it (“choking hazard”, “choke or suffocate”, “children under 8”, “keep uninflated balloons”, “uninflated or broken balloons”), in the product’s own content as the page drew it in a real browser (tabs and accordions included), in the product’s description in the product list, and in the names of the product’s gallery images (a warning graphic). Only English pages are judged (the page’s language tag, or Shopify’s language for the store when the theme sets none), and not a page whose product content couldn’t be read. The finding names the listing, the words that make it a latex balloon listing, and the tabs and links it saw.

Members-only pages aren’t judged: a page without an add-to-cart form that shows a password or verification form in its content, such as a lock app’s (Easy Lockdown, Locksmith) or a VIP sign-in in the theme. A sign-in box in the header, the footer, a pop-up or a drawer doesn’t count, since it’s on every page. Neither is a product page used for a consultation or a quote: one without an add-to-cart form whose main content asks the shopper to request a quote, talk to a specialist or book a consultation. An ask your buyable product pages show too, such as a banner on every page, doesn’t count.

  1. Add this under the description of every latex balloon product, or once in the product template for products tagged latex: “WARNING: CHOKING HAZARD – Children under 8 yrs. can choke or suffocate on uninflated or broken balloons. Adult supervision required. Keep uninflated balloons from children. Discard broken balloons at once.”
  2. Include kits, bouquets and garlands that contain latex balloons.
  3. Check a listing on a phone: the warning should be on the product page, not only on a policy page.
